Winible App

Winible is a pioneering web3 platform, bridging the world of wine and spirits with decentralized technology. It provides a unique digital space where professionals and enthusiasts converge to explore, trade, and authenticate wine and spirit real asset through Non-Fungible Tokens (NFTs). Each asset is represented by a distinct NFT, which certifies ownership and authenticity in a secure, decentralized manner on the blockchain. Users can explore collections, purchase NFTs representing their chosen bottles, and engage in a new-age collectible experience. All transactions and NFT management are conducted via the blockchain, ensuring transparency and security. Users are responsible for managing their electronic wallets and associated private keys.

PAYMENT

When purchasing a Winible NFT through our smart contract, all transactions are conducted through a blockchain network. Winible has no control over these transactions and cannot cancel them or perform related operations. Winible is not liable for claims or damages from any transaction made through the app. Transaction fees for the blockchain network, which fund the network, may be applicable for every transaction. Additional fees, including but not limited to wine import taxes or other fees related to NFT possession, sale, or use, may apply.

OWNERSHIP

NFTs purchased on our app are your sole property, managed technically by the blockchain network. Owners can claim the associated wine bottle, subject to delivery function availability and related options. However, it's your responsibility to inform yourself about the specificities of bottle ownership guaranteed by a Winible NFT and to ensure your country’s legal provisions are in accordance with our terms of use.

RESTRICTIONS

By using the app or purchasing a Winible NFT, you confirm not to be listed, or associated with any person or entity listed, on any sanctioned or denied persons list from organizations or jurisdictions that would prohibit you from using our services. Furthermore, you confirm not to be resident or citizen of or located in a geographic area that is subject to embargoes by any legal authority. Non-compliance with these conditions will not render Winible liable in any form.

TERMINATION

In the event of a Force Majeure Event, breach of these Terms, or any other event that would make provision of the Web App unviable for Winible, we may suspend your access to all or part of the Web App without liability.

CHANGES TO THE TERMS

These Terms may change periodically to accommodate changes in our Web App, or in any other instances deemed appropriate to enhance user experience.

LEGAL AGE

You confirm that you are of legal age to purchase and consume alcohol as the Web App is not intended for persons under the legal drinking age.

ASSUMPTION OF RISK

You acknowledge and accept the various risks associated with using cryptocurrencies and blockchain networks. Winible is not responsible for any communication failures, disruptions, errors, distortions, or delays you may experience when using the network, however caused.

INDEMNIFICATIONS

You agree to indemnify and hold harmless Winible and its affiliates from any claims, liabilities, damages, losses, and expenses arising out of your use of the Winible app.

APPLICABLE LAW

These Terms and all claims related or arising out of this agreement, or breach thereof, whether in contract, tort, or otherwise, shall be governed by the laws of France.
